CAS Corruption - Child Stealing at its Best

A young woman gives birth at the age of 17 and that child is apprehended based on the CAS claiming the mother has no mothering experience (does any first time mom regardless of age?) .  After 6 months of fighting and delays (so typical of these child protection workers worldwide), the baby is released from the clutches of the CAS and given to the grandmother. The grandmother now has full custody of the little girl.

A few years later the young woman has another child, this time CAS decided to give her a chance in raising the baby and she did a good job, she put the child and their needs first and the young woman's family was very proud of her! She decided to travel to Trinidad to visit the child's family with the father of the baby. During that time the CAS decided that they would apply for a supervision order since the young mom missed some appointments while out of the country. The young mom was then in violation of a supervision order she knew nothing about.

When the CAS learned the mother was out of the country, they tried to paint a picture that she was avoiding a supervision order.. but, the young mom was unaware of the order.. the CAS worked hard and was able to get the young woman sent home from Trinidad (she wanted to come home anyways) when the young mom stepped off the plane, her child was apprehended.

Pretty much right away the judge wanted the child back with mom.. and mom gave birth to another child that was apprehended at birth..grandma had put forth the paperwork to get the children but it was pushed aside when the intention seemed to be that the children would go with mom.. but the CAS being the way they are delayed and delayed that from happening.... finally a judge ordered the children returned

A worker visited the home before the return date, the oldest child's bed wasn't set up (mom was waiting for her stepfather to return from work to help her set it up) and based on that.. the CAS decided to take her back to court seeking crownwardship of the children.. over a bed you say?? yes!!.. and the order was successful! how is that possible? well, the lawyer of the mom did not file any paper work whatsoever and didn't even speak in court.. she told the young mom it was her job to file the paperwork! mom filed a complaint with the Law Society however, she couldn't afford to appeal the decision.

Grandma was beside herself too and spoke with the worker asking her questions about her options.. the worker of course didn't respond to her questions.. the children's lawyer mentioned something to her about some kind of order for openness.. she spoke to the CAS lawyer about what she learned and was told by the CAS lawyer there was no such thing.

A few weeks later just before Christmas.. the young mom died in a car accident.

The grandmother learned that she does have options.. an openness order and also section 59.4 of the Child and Family Services Act based on that section grama sent the CAS a letter asking for them to permit access and communication with her 2 grand children..

The CAS told her no.. they claim it's in the children's best interests to be adopted, that they've considered her request and don't think it fits in with their plans for the children

They pushed grandma aside at the beginning.. they delayed and waited for any excuse to make sure the mum didn't get the kids back.. They told grama there was nothing she could do.. Mum passes away and they can't even allow grama to be part of the children's lives? she has no intentions on interfering with the adoption.. she just wants to see the kids.. to know them.. to love them.. to make sure that the older sibling knows and loves them too..

It's just another case to the long line of reasons to why there needs to be accountability...  people need to know their rights...  and workers and lawyers need to be honest and upfront with the families they are destroying.. errrr.. serving.

The grandmother is going to keep trying some options and if anyone in the Haldimand-Norfolk area can be of any assistance whether it be helping her understand the law, sitting with her and supporting her through court dates or even just being a friend to her in this very difficult time.. please send us a message and we can pass it to her.
