Lawful exemptions under the NSW Public Health Order Act 2010

Under the NSW Public Health Order Act 2010, page 6 lists the lawful exemptions and are as follows: โ€‹ โ€‹ https://legislation.nsw.gov.au/.../Public%20Health%20...

(5) Subclauses (1)โ€“(4) do not apply to the following personsโ€” โ€‹ โ€‹ โ€‹ โ€‹

(a) a person aged 12 years or under, โ€‹ โ€‹ โ€‹ โ€‹

(b) a person with a physical or mental health illness or condition, or disability, that makes wearing a fitted face covering unsuitable including, for example, a skin condition, an intellectual disability, autism, or trauma. โ€‹

โ—พ๏ธโ€‹Despite subclauses (1)โ€“(4), a person may remove a fitted face covering the person isโ€‹ otherwise required to wear in the following circumstancesโ€”โ€‹

(a) the person is eating or drinking,โ€‹

(b) the person is communicating with another person who is deaf or hard ofโ€‹ hearing,โ€‹

(c) the person is at work and the nature of the personโ€™s workโ€”โ€‹

(i) makes the wearing of a fitted face covering a risk to the personโ€™s, orโ€‹ another personโ€™s health and safety, orโ€‹

(ii) means clear enunciation or visibility of the personโ€™s mouth is essential,โ€‹

(d) the person is asked to remove the fitted face covering to ascertain the personโ€™sโ€‹ identity,โ€‹

(e) because of an emergency,โ€‹

(f) the removal of the fitted face covering is necessary for the proper provision ofโ€‹ the goods or service.โ€‹

Example. A person having a facial or a beard trim.โ€‹

You do not need documentary evidence stating that you are exempted from wearing a face mask under the public health order. โ€‹ โ€‹ โ€‹ โ€‹

Regulatory officers are focused on compliance rather than enforcement. If you are stopped by a regulatory officer in a setting where masks are mandatory, they will ask you to confirm the lawful reason you are not wearing a face mask. Officers will only issue penalty notices if you clearly refuse to wear a mask without a lawful reason.โ€‹
