"“Christian School” charges parent $30,000 for a School Report Card at Emmanuel College Gold Coast Australia"

RELEASE DATE – 7 AUGUST 2013

Today, in the Federal Circuit Court of Australia, Mr Chad Rowe was ordered to pay Emmanuel College Gold Coast $29,988.49 in legal costs, in an action Mr Rowe brought against the school simply seeking a copy of his daughters report card under Australian Consumer Law.  Mr Rowe’s daughter attends Emmanuel College Christian School Gold Coast.

Emmanuel College Christian School Gold Coast has a policy that they will not supply a report card to both parents, unless the other parent pays an additional charge of between $100-250.  Mr Rowe could not afford to pay this fee, nor was he ever told of this fee, and therefore could not obtain a copy of this daughters report card.  Mr Rowe suffers from an adjustive depressive disorder, cannot work full time, and his only source of income is a Sickness Allowance from Centrelink.

After the proceeding, Emmanuel College sent a report card to him “ex-gratis”.  However, Mr Rowe was still left with Emmanuel College’s legal bill of $29,988.49 to pay.

The matter will be appealed to the Federal Court, along with Emmanuel College’s other matters sought by Mr Rowe in the areas of misleading and deceptive conduct, unconscionable conduct and unfair contract terms under Australian Consumer Law.

Emmanuel College Christian School Gold Coast, represented by its directors, Salli-Anne Taylor, Jeffrey Edward Hills, Corey Michael Lun, Andrew John Lind, Mary-Anne Rulfs, Gregory James Cook, Sadie Praeger, Graham Leslie Leo and Alfred James Stonier sought this costs application against Mr Rowe after they provided him with a copy of his daughters report card.  They have indicated that they will now proceed to bankrupt Mr Rowe over his actions in court trying to obtain a copy of his daughters report card.

Further, if you think Mr Rowe could have just terminated the enrolment contract and enrolled his child elsewhere.  Well, he tried that, and the school ignored his request.
